The Commercial Court of First Instance no. 6 of Lleida has forgiven a debt of 203,283 euros to a father and his daughter who guaranteed a fruit company, which suffered the non-payment of more than one million euros from the main marketing company it had when it went bankrupt. The judge has applied the Second Chance Law to the present litigation by considering that the two actors are debtors in good faith, thus exonerating the 81-year-old man from the unsatisfied liability of 31,834 euros, and the 51-year-old daughter of 171,449 euros . The economic insolvency of the actors was caused by the endorsement of a fruit company , which was dedicated to purchasing fruit from farmers for subsequent commercialization in the markets.

For years the business gave the expected returns, even more and, therefore, both his father and his daughter requested loans that they invested in expanding the warehouses and offices , in order to increase production. The family has Fax Lists been represented by lawyer Marta Bergadà , founding partner of the Bergadà Asociados firm , who explained to this medium that “more financing was even requested to plant and operate a fruit farm owned by the company in order not to depend on "only from the production of other external farmers." However, everything began to falter in 2009 when the main marketing company that worked with the company went bankrupt, leaving more than a million euros unpaid .



Thus, the aforementioned company could not meet its contracted obligations. It should be said that its credits were guaranteed by the different partners, including the good faith debtors in this case. Consequently, the partnership that father and daughter endorsed was totally affected and the obligations contracted could not be met.
